TERMS & CONDITIONS

For reasons of readability, the masculine form is used throughout these Terms and Conditions.
All genders are included and treated equally.

 

 

1. Validity of the Terms and Conditions

1.1

These Terms and Conditions apply to every use of the website of The Gentledog Academy KLG (hereinafter: “the Company”), any communication by e-mail or other means, phone calls, customer inquiries, and/or the provision of services.

 

1.2

By visiting or using the website, or by communicating with the Company, the user or client acknowledges that they have read these Terms and Conditions and accept them fully as binding.

 

2. Registration

2.1

Registrations are made either via the booking tool on the website or by e-mail.

 

3. Cancellation

 

3.1

Individual lessons, group lessons, home visits, and consultations (initial session) must be cancelled in writing at least 48 hours before the scheduled appointment. Otherwise, the full cost will be charged or deducted from an existing package.

 

3.2

Events, seminars, and workshops must be cancelled at least 2 weeks prior to the start date. Otherwise, the full cost will be charged.

 

3.3

In the event of absence without cancellation, an administrative fee of CHF 50.– will be charged.

 

3.4

Cancellations for appointments on Mondays must be made by Friday evening no later than 18:00 Swiss time. The same applies to recognised public holidays.

 

3.5

The Company reserves the right to cancel lessons at short notice due to exceptional circumstances, such as illness or accident of the Company. Such lessons will not be charged.

 

4. Conduct Rules and Framework Conditions

4.1

The Company undertakes to handle dogs in a manner appropriate to their species and behaviour and to comply with the Animal Welfare Act and its associated regulations.

 

4.2

All dogs must be microchipped and in good health. If a dog is ill or displays behavioural irregularities, the owner is required to notify the instructor in advance. This also applies in the case of a female dog in heat.

 

4.3

The dog owner confirms that their dog is healthy and free from contagious diseases.

 

4.4

Lead control applies in the parking area, within the facility, on the training premises, and in the surrounding area. Dogs may only be released upon explicit instruction of the instructor. Participants must collect and dispose of their dog’s waste. Smoking and phone calls are prohibited during lessons.

 

4.5

In the event of inappropriate or non-species-appropriate behaviour, the Company reserves the right to exclude a person from the course without issuing a course certificate and without reimbursement. Out of consideration for insecure dogs: without prior agreement, there is no contact between leashed dogs. A minimum distance of 4 metres must be maintained between human–dog teams.

 

4.6

If a participant is late more than 10 minutes, they may no longer take part in the lesson or any other event.

 

4.7

The Company reserves the right to change the training location for operational reasons. Any claims arising from such a change are excluded.

 

4.8

The Company reserves the right to cancel or postpone any course or training session in the event of insufficient participant numbers or extraordinary circumstances. Any claims arising from such cancellation are excluded.

 

4.9

If a fight occurs between dogs, they will be separated and, in the event of injury, treated by a veterinarian. If the aggressor can be clearly identified, the owner of that dog bears all resulting costs. If no clear identification is possible, each owner bears the veterinary costs for their own dog.

 

4.10

The Company reserves the right to place a muzzle on a dog if necessary.

 

4.11

The Company is authorised to take any measures necessary to maintain operations without prior consultation with the dog owner.

 

4.12

The dog owner is required to contribute to maintaining order within the Company’s operations.

 

5. Insurance and Liability

5.1

Accident and liability insurance is the sole responsibility of the participant or dog owner.

 

5.2

During training, dog owners bear full responsibility and liability for themselves, their dog, and any accompanying persons. Dogs must be insured in accordance with applicable legal requirements. Compliance with these insurance obligations lies solely with the dog owner.

 

5.3

In the event of theft, loss, or damage to a participant’s property during their stay at the training venue, the Company is liable only in cases of intent or gross negligence.

 

5.4

The Company assumes no liability for material, personal, and/or financial damages resulting from the application of exercises demonstrated during training, nor for damages or injuries caused by participating dogs. Participants are liable for damages caused by themselves or their dog. Any accompanying persons are considered participants.

 

5.5

The Company also accepts no liability for injuries to dogs or humans that may arise during off-leash play between dogs.

 

5.6

The Company provides no warranty for the accuracy, completeness, reliability, or quality of the information provided. Liability claims resulting from the use or non-use of the information offered, or from the use of incorrect or incomplete information, are excluded. The Company assumes no liability for direct or indirect references to external websites and the content of such sites.

 

5.7

The dog owner is liable, among other things, for the following damages and any resulting costs:

 

  • Damage to persons or property caused by their dog, even if all customary precautions by the Company have been taken.

  • Illnesses of the dog and any resulting veterinary treatment.

  • Injuries to the dog caused by the dog’s own behaviour.

  • Transmission of disease to other dogs resulting from undisclosed or unknown illnesses or parasites.

  • Unintended mating caused by undisclosed heat of a female dog.

5.8

If a dog, despite customary supervision and precautions, causes damage, escapes and/or cannot be recovered, the dog owner is liable. Furthermore, the owner assumes liability for any damage or injury the dog causes to people and/or animals.

 

5.9

Items belonging to the dog owner, such as baskets, blankets, leashes, toys, etc., are considered not to be brought into the Company’s custody. The Company accepts no liability for damage to such items.

 

5.10

If, despite all reasonable care and precautions, a dog dies, escapes and/or cannot be recovered, or is stolen, the dog owner explicitly and fully waives any compensation or damage claim.

 

5.11

If the dog owner violates these Terms and Conditions or disregards the Company’s instructions, the Company’s liability is excluded.

 

6. Payment

6.1

No invoices are issued.

 

6.2

The current price list is part of these Terms and Conditions and can be viewed on the Company’s website at: gentledog-academy.ch

 

7. Intellectual Property

7.1

All photos and video recordings taken during courses or other services may be used by the Company for educational purposes and/or for publication on the Company’s website and social media channels. Participants who do not agree must inform the Company in writing no later than before the start of the course or service.

 

7.2

The dog owner agrees that the Company may use photographs of their dog for promotional material, advertisements, and social media, without mentioning names.

 

7.3

All documents, materials, and training content provided by the Company are protected by copyright and are intended solely for personal use. This also applies to all content and images on the Company’s website. Any reproduction, distribution, or sharing in whole or in part is permitted only with the explicit written consent of the Company.

 

8. Disclaimer

8.1

The content and links available on the Company’s website are provided solely for informational purposes. They do not constitute any legal or contractual relationship between the website visitor and the Company. Any liability for damages arising from the use or non-use of the website or the information provided on it is excluded. In particular, the Company assumes no liability for the accuracy, completeness, or correctness of the content. Liability for links to third-party websites and the content of such websites is likewise excluded.

 

9. Severability

9.1

If any provision of these Terms and Conditions is deemed invalid or unenforceable, the remaining provisions remain unaffected and continue to apply.

 

9.2

Deviations from these Terms and Conditions are valid only if agreed in writing.

 

10. Governing Law

10.1

Exclusive governing law is Swiss law.

 

11. Jurisdiction

 

11.1

The place of jurisdiction is determined by the registered location of the Company.
